परिसीमा अधिनियम की धारा 16 | Section 16 of limitation act

[ limitation act Sec. 16 in Hindi ] –

वाद लाने का अधिकार प्रोद्भूत होने पर या होने के पूर्व मृत्यु हो जाने का प्रभाव–

(1) जहाँ कि कोई व्यक्ति, जिसे यदि वह जीवित रहता तो वाद संस्थित करने या आवेदन करने का अधिकार होता, उस अधिकार के प्रोद्भूत होने के पहले मर जाए या जहां कि वाद संस्थित करने या आवेदन करने का अधिकार किसी व्यक्ति की मृत्यु पर ही प्रोद्भूत होता हो वहाँ परिसीमा काल की संगणना उस समय से की जाएगी जब मृतक का ऐसा विधिक प्रतिनिधि हो जाए जो ऐसा वाद संस्थित करने या आवेदन आवेदित करने के लिए समर्थ हो।

(2) जहां कि कोई व्यक्ति, जिसके विरुद्ध यदि वह जीवित रहता तो वाद संस्थित करने या आवेदन करने का अधिकार प्रोद्भूत हुआ होता, उस अधिकार के प्रोद्भूत होने के पहले मर जाए, या जहां किसी व्यक्ति के विरुद्ध वाद संस्थित करने या आवेदन करने का अधिकार उसकी मृत्यु पर प्रोद्भूत होता हो, वहाँ परिसीमा काल की संगणना उस समय से की जाएगी जब मृतक का ऐसा विधिक प्रतिनिधि हो जाए जिसके विरुद्ध वादी ऐसा वाद संस्थित कर सके या आवेदन कर सके।

(3) उपधारा (1) या उपधारा (2) की कोई भी बात शुफा अधिकारों को प्रवर्तित कराने के वादों को अथवा किसी स्थावर सम्पत्ति के या आनुवंशिक पद के कब्जे के बाद को लागू नहीं होती।

धारा 16 limitation act

[ limitation act Sec. 16 in English ] –

“ Effect of death on or before the accrual of the right to sue ”–

(1) Where a person who would, if he were living, have a right to institute a suit or make an application dies before the right accrues, or where a right to institute a suit or make an application accrues only on the death of a person, the period of limitation shall be computed from the time when there is a legal representative of the deceased capable of instituting such suit or making such application.

(2) Where a person against whom, if he were living, a right to institute a suit or make an application would have accrued dies before the right accrues, or where a right to institute a suit or make an application against any person accrues on the death of such person, the period of limitation shall be computed from the time when there is a legal representative of the deceased against whom the plaintiff may institute such suit or make such application.

(3) Nothing in sub-section (1) or sub-section (2) applies to suits to enforce rights of pre-emption or to suits for the possession of immovable property or of a hereditary office.
