घरेलू हिंसा अधिनियम की धारा 9 | Section 9 of Domestic violence act
[ Domestic violence act Sec. 9 in Hindi ] –
संरक्षण अधिकारियों के कर्तव्य और कृत्य.-
(1) संरक्षण अधिकारी के निम्नलिखित कर्तव्य होंगे-
(क) किसी मजिस्ट्रेट को, इस अधिनियम के अधीन उसके कृत्यों के निवर्हन में सहायता करना;
(ख) किसी मजिस्ट्रेट को, किसी घरेलू हिंसा की शिकायत की प्राप्ति पर और उस पुलिस थाने के भारसाधक पुलिस अधिकारी को उसकी प्रतियाँ अग्रेषित करके, जिसकी अधिकारिता की स्थानीय सीमा के भीतर घरेलू हिंसा का होना अभिकथित किया गया है और उस क्षेत्र की सेवा प्रदाताओं को उसकी प्रतियाँ अग्रेषित करके, किसी घरेलू घटना की रिपोर्ट ऐसे प्ररूप में और ऐसी रीति में जो विहित की जाए, करना;
(ग) किसी मजिस्ट्रेट को, यदि व्यथित व्यक्ति, किसी संरक्षण आदेश के जारी करने के लिए, अनुतोष का दावा करने की वांछा करता हो, तो ऐसे प्ररूप और ऐसी रीति में .जो विहित की जाएं, आवेदन करना;
(घ) यह सुनिश्चित करना कि किसी व्यथित व्यक्ति को विधिक सेवा प्राधिकरण अधिनियम, 1987 के अधीन विधिक सहायता उपलब्ध कराई जाती है विहित प्ररूप को जिसमें शिकायत की जानी है, मुफ्त उपलब्ध कराए जाने को;
(ड) सभी सेवा प्रदाताओं को जो मजिस्ट्रेट की अधिकारिता वाले स्थानीय क्षेत्र में, विधिक सहायता या परामर्श, आश्रय गृहों और चिकित्सीय सुविधा उपलब्ध कराते हैं, एक सूची का अनुरक्षण करना;
(च) यदि व्यथित व्यक्ति ऐसी अपेक्षा करता है तो कोई सुरक्षित आश्रय गृह का उपलव्य कराना और किसी व्यक्ति को आश्रय गृह में सौंपते हुए, अपनी रिपोर्ट की एक प्रति पुलिस थाने को और उस क्षेत्र में अधिकारिता रखने वाले मजिस्ट्रेट को, जहाँ वह आश्रय गृह अवस्थित है, अग्रेषित करना;
(छ) यदि व्यथित व्यक्ति को शारीरिक क्षतियाँ हुई हैं तो उसका चिकित्सीय परीक्षण कराना, और उस क्षेत्र में, जहाँ घरेलू हिंसा का होना अभिकथित किया गया है, पुलिस थाने को और अधिकारिता रखने वाले मजिस्ट्रेट को उस चिकित्सीय रिपोर्ट की एक प्रति अग्रेषित करना;
(ज) यह सुनिश्चित करना कि धारा 20 के अधीन धनीय राहत के लिए आदेश का, दण्ड प्रक्रिया संहिता, 1973 के अधीन विहित प्रक्रिया के अनुसार अनुपालन और निष्पादन हो गया है।
(झ) ऐसे अन्य कर्तव्यों का, जो विहित किए जाएं, पालन करना।
(2) संरक्षण अधिकारी, मजिस्ट्रेट के नियंत्रण और पर्यवेक्षण के अधीन होगा और वह, इस अधिनियम द्वारा या उसके अधीन मजिस्ट्रेट और सरकार द्वारा उस पर अधिरोपित कर्तव्यों का पालन करेगा।
धारा 9 Domestic violence act
[ Domestic violence act Sec. 9 in English ] –
“ Duties and functions of Protection Officers ”–
(1) It shall be the duty of the Protection Officer-
(a) to assist the Magistrate in the discharge of his functions under this Act;
(b) to make a domestic incident report to the Magistrate, in such form and in such manner as may be prescribed, upon receipt of a complaint of domestic violence and forward copies thereof to the police officer in charge of the police station within the local limits of whose jurisdiction domestic violence is alleged to have been committed and to the service providers in that area;
(c) to make an application in such form and in such manner as may be prescribed to the Magistrate, if the aggrieved person so desires, claiming relief for issuance of a protection order;
(d) to ensure that the aggrieved person is provided legal aid under the Legal Services Authorities Act, 1987 (39 of 1987) and make available free of cost the prescribed form in which a complaint is to be made;
(e) to maintain a list of all service providers providing legal aid or counselling, shelter homes and medical facilities in a local area within the jurisdiction of the Magistrate;
(f) to make available a safe shelter home, if the aggrieved person so requires and forward a copy of his report of having lodged the aggrieved person in a shelter home to the police station and the Magistrate having jurisdiction in the area where the shelter home is situated;
(g) to get the aggrieved person medically examined, if she has sustained bodily injuries and forward a copy of the medical report to the police station and the Magistrate having jurisdiction in the area where the domestic violence is alleged to have been taken place;
(h) to ensure that the order for monetary relief under section 20 is complied with and executed, in accordance with the procedure prescribed under the Code of Criminal Procedure, 1973 (2 of 1974);
(i) to perform such other duties as may be prescribed.
(2) The Protection Officer shall be under the control and supervision of the Magistrate, and shall perform the duties imposed on him by the Magistrate and the Government by, or under, this Act.
