अननुग्रहिक कार्य का फायदा उठाने वाले व्यक्ति की बाध्यता-
जहां कि कोई व्यक्ति किसी अन्य व्यक्ति के लिए कोई बात या उसे किसी चीज का परिदान आनुग्रहिकतः करने का आशय न रखते हुए विधिपूर्वक करता है और ऐसा अन्य व्यक्ति उसका फायदा उठाता है वहां वह पश्चात्कथित व्यक्ति, उस पूर्वकथित व्यक्ति को ऐसे की गई बात या परिदत्त चीज के बारे में प्रतिकर देने या उसे प्रत्यावर्तित करने के लिए आबद्ध है।
दृष्टांत
(क) एक व्यापारी क कुछ माल ख के गृह पर भूल से छोड़ जाता है । ख उस माल को अपने माल के रूप में बरतता है। उसके लिए क को संदाय करने के लिए वह आबद्ध है।
(ख) ख की सम्पत्ति को क आग से बचाता है । यदि परिस्थितियां दर्शित करती हों कि क का आशय आनुग्रहिकतः कार्य करने का था, तो वह ख से प्रतिकर पाने का हकदार नहीं है।
धारा 70 Indian Contract act
[ Indian Contract act Sec. 70 in English ] –
“Obligation of person enjoying benefit of non-gratuitous act”–
Where a person lawfully does anything for another person, or delivers anything to him, not intending to do so gratuitously, and such other person enjoys the benefit thereof, the latter is bound to make compensation to the former in respect of, or to restore, the thing so done or delivered1.
Illustrations
(a) A, a tradesman, leaves goods at B‟s house by mistake. B treats the goods as his own. He is bound to pay A for them.
(b) A saves B‟s property from fire. A is not entitled to compensation from B, if the circumstances show that he intended to act gratuitously.
