वचन पालन के लिए समय जहां कि पालन के लिए आवेदन न किया जाना हो और कोई समय विनिर्दिष्ट न हो-
जहां कि संविदा के अनुसार वचनदाता को अपने वचन का पालन वचनगृहीता द्वारा आवेदन किए जाने के बिना करना हो और पालन के लिए कोई समय विनिर्दिष्ट न हो वहां वचनबन्ध का पालन युक्तियुक्त समय के भीतर करना होगा।
स्पष्टीकरण-“युक्तियुक्त समय क्या है, यह प्रश्न हर एक विशिष्ट मामले में तथ्य का प्रश्न है।
धारा 46 Indian Contract act
[ Indian Contract act Sec. 46 in English ] –
“Time for performance of promise, when no application is to be made and no time is specified”–
Where, by the contract, a promisor is to perform his promise without application by the promisee, and no time for performance is specified, the engagement must be performed within a reasonable time.
Explanation.—The question “what is a reasonable time” is, in each particular case, a question of fact.
