[ Indian Forest Act Section 39 in Hindi ] –
इमारती लकड़ी और अन्य वन–उपज पर शुल्क अधिरोपित करने की शक्ति–
(1)केन्द्रीय सरकार] ऐसी रीति से, ऐसे स्थानों में और ऐसी दरों पर, जैसी वह राजपत्र में अधिसूचना द्वारा घोषित करे, उस सब इमारती लकड़ी या वन-उपज पर शुल्क उद्गृहीत कर सकेगी-
(क)जोउन राज्यक्षेत्रों में, जिन पर इस अधिनियम का विस्तार है पैदा की जाती है और जिसके विषय में सरकार को कोई अधिकार प्राप्त है, या
(ख) जो उन राज्यक्षेत्रों के, जिन पर इस अधिनियम का विस्तार है, बाहर के किसी स्थान से लाया जाता है ।
(2) ऐसे हर मामले में, जिसमें ऐसे शुल्क की बाबत यह निर्दिष्ट किया गया है कि वह मूल्यानुसार उद्गृहीत किया जाए, 1[केन्द्रीय सरकार] वैसी ही अधिसूचना द्वारा, वह मूल्य नियत कर सकेगी जिस पर ऐसा शुल्क निर्धारित होगा ।
(3) इमारती लकड़ी या अन्य वन-उपज पर जो शुल्क उस समय, जब वह अधिनियम किसी राज्यक्षेत्र में प्रवृत्त होता है, राज्य सरकार के प्राधिकार के अधीन उसमें उद्गृहीत होते हैं, उन सब की बाबत यह समझा जाएगा कि वे इस अधिनियम के उपबन्धों के अधीन उद्गृहीत होते हैं और सम्यक् रूप से उद्गृहीत होते रहे हैं ।
1[(4) जब तक कि 2[संसद्] द्वारा प्रतिकूल उपबन्ध नहीं किया जाता, राज्य सरकार इस धारा में किसी बात के होते हुए भी किसी शुल्क को लगातार उद्गृहीत कर सकेगी, जिसे वह 3[संविधान] के प्रारंभ4 के पूर्व इस धारा के उस समय प्रवृत्त रूप में विधिपूर्णतः उद्गृहीत करती थीः
परन्तु इस उपधारा की कोई बात ऐसे किसी शुल्क का उद्ग्रहण प्राधिकृत नहीं करती जो राज्य की इमारती लकड़ी या अन्य वन-उपज और राज्य के बाहर के स्थान की समरूप इमारती लकड़ी या अन्य वन-उपज के बीच पूर्वकथित के पक्ष में विभेद करता है, या जो राज्य के बाहर किसी स्थान की इमारती लकड़ी या अन्य वन-उपज के मामले में, किसी एक स्थान की इमारती लकड़ी या अन्य वन-उपज और अन्य स्थान की समरूप इमारती लकड़ी या वन-उपज के बीच विभेद करता है ।]
भारतीय वन अधिनियम धारा 39
[ Indian Forest Act Section 39 in English ] –
“Power to impose duty on timber and other forest-produce”–
(1) The 7[Central Government] may levy a duty in such manner, at such places and at such rates as it may declare by notification in the Official Gazette on all timber or other forest-produce
(a) which is produced in 8[the territories to which this Act extends], and in respect of which the
Government has any right;
(b) which is brought from any place outside 8[the territories to which this Act extends].
(2) In every case in which such duty is directed to be levied ad valorem the 7[Central Government] may fix by like notification the value on which such duty shall be assessed.
(3) All duties on timber or other forest-produce which, at the time when this Act comes into force in any territory, are levied therein under the authority of the State Government, shall be deemed to be and to have been duty levied under the provisions of this Act.
10[(4) Notwithstanding anything in this section, the State Government may, until provision to the contrary is made by 11[Parliament], continue to levy any duty which it was lawfully levying before the commencement12 of 13[the Constitution], under this section as then in force:
Provided that nothing in this sub-section authorises the levy of any duty which as between timber or other forest-produce of the State and similar produce of the locality outside the State, discriminates in favour of the former, or which, in the case of timber or other forest-produce of localities outside the State, discriminates between timber or other forest-produce of one locality and similar timber or other forest-produce of another locality.]
