प्रक्रियां जहां अभियुक्त कार्यवाही नहीं समझता है-
यदि अभियुक्त विकृत-चित्त न होने पर भी ऐसा है कि उसे कार्यवाही समझाई नहीं जा सकती तो न्यायालय जांच या विचारण में अग्रसर हो सकता है ; और उच्च न्यायालय से भिन्न न्यायालय की दशा में, यदि ऐसी कार्यवाही का परिणाम दोषसिद्धि है, तो कार्यवाही को मामले की परिस्थितियों की रिपोर्ट के साथ उच्च न्यायालय भेज दिया जाएगा और उच्च न्यायालय उस पर ऐसा आदेश देगा जैसा वह ठीक समझे।
धारा 318 CrPC
[ CrPC Sec. 318 in English ] –
“Procedure where accused does not understand proceedings ”–
If the accused, though not of unsound mind, cannot be made to understand the proceedings, the Court may proceed with the inquiry or trial; and, in the case of a Court other than a High Court, if such proceed- ings result in a conviction, the proceedings shall be forwarded to the High Court with a report of the circumstances of the case, and the High Court shall pass thereon such order as it thinks fit.
