[ CrPC Sec. 292 in Hindi ] –

टकसाल के अधिकारियों का साक्ष्य–

(1) कोई दस्तावेज, जो, यथास्थिति, किसी टकसाल या नोट छपाई मुद्राणालय के या सिक्योरिटी प्रिंटिंग प्रेस के (जिसके अन्तर्गत स्टांप और लेखन सामग्री नियंत्रक का कार्यालय भी है) या न्याय संबंधी विभाग या न्यायालयिक प्रयोगशाला प्रभाग के ऐसे अधिकारी की या प्रश्नगत दस्तावेजों के सरकारी परीक्षक या प्रश्नगत दस्तावेजों के राज्य परीक्षक की] जिसे केन्द्रीय सरकार अधिसूचना द्वारा इस निमित्त विनिर्दिष्ट करे, इस संहिता के अधीन किसी कार्यवाही के दौरान परीक्षा और रिपोर्ट के लिए सम्यक्त रूप से उसे भेजी गई किसी सामग्री या चीज के बारे में स्वहस्ताक्षरित रिपोर्ट होनी तात्पर्यित है. इस संहिता के अधीन किसी जांच, विचारण या अन्य कार्यवाही में साक्ष्य के तौर पर उपयोग में लाई जा सकेगी, यद्यपि ऐसे अधिकारी को साक्षी के तौर पर नहीं बुलाया गया है।

(2) यदि न्यायालय ठीक समझता है तो वह ऐसे अधिकारी को समन कर सकता है और उसकी रिपोर्ट की विषयवस्तु के बारे में उसकी परीक्षा कर सकता है :

परन्तु ऐसा कोई अधिकारी किन्हीं ऐसे अभिलेखों को पेश करने के लिए समन नहीं किया जाएगा जिन पर रिपोर्ट आधारित है।

(3) भारतीय साक्ष्य अधिनियम, 1872 (1872 का 1) की धारा 123 और 124 के उपबंधों पर प्रतिकूल प्रभाव डाले बिना यह है कि ऐसा कोई अधिकारी [यथास्थिति, किसी टकसाल या नोट छपाई मुद्राणालय या सिक्योरिटी प्रिंटिंग प्रेस या न्याय संबंधी विभाग के महाप्रबंधक या किसी अन्य भारसाधक अधिकारी या न्यायालयिक प्रयोगशाला के भारसाधक किसी अधिकारी या प्रश्नगत दस्तावेज संगठन के सरकारी परीक्षक या प्रश्नगत दस्तावेज संगठन के राज्य परीक्षक की] अनुज्ञा के बिना,

(क) ऐसे अप्रकाशित शासकीय अभिलेखों से, जिन पर रिपोर्ट आधारित है, प्राप्त कोई साक्ष्य देने के लिए अनुज्ञात नहीं किया जाएगा; अथवा

(ख) किसी सामग्री या चीज की परीक्षा के दौरान उसके द्वारा किए गए परीक्षण के स्वरूप या विशिष्टियों को प्रकट करने के लिए अनुज्ञात नहीं किया जाएगा।

धारा 292 CrPC

[ CrPC Sec. 292 in English ] –

“ Evidence of officers of the Mint”–

1. Any document purporting to be a report under the hand of any such officer of any Mint or of any Note Printing Press or of any Security Printing Press (including the officer of the Controller of Stamps and Stationery) or of any Forensic Department or Division of Forensic Science Laboratory or any Government Examiner of Questioned Documents or any State Examiner of Questioned Documents, as the case may be as the Central Government may, by notification, specify in this behalf, upon any matter or thing duly submitted to him for examination and report in the course of any proceeding under this Code, may be used as evidence in any inquiry, trial or other proceeding under this Code, although such officer is not called as a witness.
2. The Court may, if it thinks fit, summon and examine any such officer as to the subject-matter of this report;
   Provided that no such officer shall be summoned to produce any records on which the report is based.
3. Without prejudice to the provisions of sections 123 and 124 of the Indian Evidence Act, 1872 (1 of 1872) no such officer shall,except with the permission of the General Manager or any officer in charge of any Mint or of any Note Printing Press or of any Security Printing Press or of any Forensic Department or any officer in charge of the Forensic Science Laboratory or of the Government Examiner of Questioned Documents Organisation or of the State Examiner of Questioned Documents Organisation, as the case may be, be permitted—
   1. to give any evidence derived from any unpublished official records on which the report is based; or
   2. to disclose the nature or particulars of any test applied by him in the course of the examination of the matter or thing.
