[ Indian Evidence Act Section 26 in Hindi ] –
” पुलिस की अभिरक्षा में होते हए अभियुक्त द्वारा की गई संस्वीकृति का उसके विरुद्ध साबित न किया जाना”
कोई भी संस्वीकृति, जो किसी व्यक्ति ने उस समय की हो जब वह पुलिस आफिसर की अभिरक्षा में हो, ऐसे व्यक्ति के विरुद्ध साबित न की जाएगी जब तक, कि वह मजिस्ट्रेट की साक्षात् उपस्थिति में न की गई हो।
स्पष्टीकरण-इस धारा में “मजिस्ट्रेट के अन्तर्गत फोर्ट सेन्ट जार्ज की प्रेसिडेन्सी में 4*** या अन्यत्र मजिस्ट्रेट के कृत्य निर्वहन करने वाला ग्रामणी नहीं आता है, जब तक कि वह ग्रामणी कोड आफ क्रिमिनल प्रोसिजर, 1882 (1882 का 10) के अधीन मजिस्ट्रेट की शक्तियों का प्रयोग करने वाला मजिस्ट्रेट न हो।
धारा 26 Indian Evidence Act
[ Indian Evidence Act Sec. 26 in English ] –
“Confession by accused while in custody of police not to be proved against him ”–
No confession made by any person whilst he is in the custody of a police-officer, unless it be made in the immediate presence of a Magistrate, shall be proved as against such person.
Explanation. –– In this section “Magistrate” does not include the head of a village discharging magisterial functions in the Presidency of Fort St. George 5*** or elsewhere, unless such headman is a Magistrate exercising the powers of a Magistrate under the Code of Criminal Procedure, 18826 (10 of 1882).
