भारतीय संविदा अधिनियम की धारा 150 | Section 150 of Indian Contract act

उपनिहित माल की त्रुटियों को प्रकट करने का उपनिधाता का कर्तव्य-
उपनिधाता, उपनिहित माल की उन त्रुटियों को उपनिहिती से प्रकट करने के लिए आबद्ध है जिनकी जानकारी उपनिधाता को हो और जो उसके उपयोग में तत्त्वतः विघ्न डालती हो या उपनिहिती को साधारण जोखिम में डालती हो और यदि वह ऐसा प्रकटीकरण नहीं करता है तो वह उपनिहिती को ऐसी त्रुटियों से प्रत्यक्षतः उद्भूत नुकसान के लिए उत्तरदायी है।
यदि माल भाड़े पर उपनिहित किया गया है तो उपनिधाता ऐसे नुकसान के लिए उत्तरदायी है चाहे उपनिहित माल की ऐसी त्रुटियों के अस्तित्व से बह परिचित था या नहीं।
दृष्टांत
(क) क एक घोड़ा ख को उधार देता है जिसका दुष्ट होना वह जानता है । वह यह तथ्य प्रकट नहीं करता कि घोड़ा दुष्ट है। घोड़ा भाग खड़ा होता है, ख को गिरा देता है और ख क्षत हो जाता है । हुए नुकसान के लिए ख के प्रति क उत्तरदायी है।
(ख) ख की एक गाड़ी क भाड़े पर लेता है । गाड़ी अक्षेमकर है, यद्यपि ख को यह मालूम नहीं है और क क्षत हो जाता है । क्षति के लिए क के प्रति ख उत्तरदायी है।
धारा 150 Indian Contract act
[ Indian Contract act Sec. 150 in English ] –
“Bailor’s duty to disclose faults in goods bailed”–
The bailor is bound to disclose to the bailee faults in the goods bailed, of which the bailor is aware, and which materially interfere with the use of them, or expose the bailee to extraordinary risks; and if he does not make such disclosure, he is responsible for damage arising to the bailee directly from such faults.
If the goods are bailed for hire, the bailor is responsible for such damage, whether he was or was not aware of the existence of such faults in the goods bailed.
Illustrations
(a) A lends a horse, which he knows to be vicious, to B. He does not disclose the fact that the horse is vicious. The horse runs away. B is thrown and injured. A is responsible to B for damage sustained.
(b) A hires a carriage of B. The carriage is unsafe, though B is not aware of it, and A is injured. B is responsible to A for the injury.
