संसद् और राज्यों के विधान-मंडलों की कार्यवाहियों के प्रकाशन का संरक्षण–
(1) कोई व्यक्ति संसद् के किसी सदन या, यथास्थिति, किसी राज्य की विधान सभा या किसी राज्य के विधान-मंडल के किसी सदन की किन्ही कार्यवाहियों के सारतः सही विवरण के किसी समाचारपत्र में प्रकाशन के संबंध में किसी न्यायालय में किसी भी प्रकार की सिविल या दांडिक कार्यवाही का तब तक भागी नहीं होगा जब तक यह साबित नहीं कर दिया जाता है कि प्रकाशन विद्वेषपूर्वक किया गया है:
परन्तु इस खंड की कोई बात संसद् के किसी सदन या, यथास्थिति, किसी राज्य की विधान सभा या किसी राज्य के विधान-मंडल के किसी सदन की गुप्त बैठक की कार्यवाहियों के विवरण के प्रकाशन को लागू नहीं होगी।
(2) खंड (1) किसी प्रसारण केन्द्र के माध्यम से उपलब्ध किसी कार्यक्रम या सेवा के भागरूप बेतार तारयांत्रिकी के माध्यम से प्रसारित रिपोर्टों या सामग्री के संबंध में उसी प्रकार लागू होगा जिस प्रकार वह किसी समाचारपत्र में प्रकाशित रिपोर्टों या सामग्री के संबंध में लागू होता है।
स्पष्टीकरण–इस अनुच्छेद में, “समाचारपत्र” के अंतर्गत समाचार एजेंसी की ऐसी रिपोर्ट है जिसमें किसी समाचारपत्र में प्रकाशन के लिए सामग्री अंतर्विष्ट है।]
भारतीय संविधान अनुच्छेद 361a
[ Indian Constitution Article 361a in English ] –
“Protection of publication of proceedings of Parliament and State Legislatures ”–
(1) No person shall be liable to any proceedings, civil or criminal, in any court in respect of the publication in a newspaper of a substantially true report of any proceedings of either House of Parliament or the Legislative Assembly, or, as the case may be, either House of the Legislature, of a State, unless the publication is proved to have been made with malice:
Provided that nothing in this clause shall apply to the publication of any report of the proceedings of a secret sitting of either House of Parliament or the Legislative Assembly, or, as the case may be, either House of the Legislature, of a State.
(2) Clause (1) shall apply in relation to reports or matters broadcast by means of wireless telegraphy as part of any programme or service provided by means of a broadcasting station as it applies in relation to reports or matters published in a newspaper.
Explanation. — In this article, “newspaper” includes a news agency report containing material for publication in a newspaper .
