आबन्धन का प्रतिषेध–
कोई भी बन्धकदार, जो पूर्विक बन्धक को मध्यवर्ती बन्धक की सूचना होते हुए या न होते हुए चुका देता है, अपनी मूल प्रतिभूति के विषय में कोई पूर्विकता तद्द्वारा अर्जित नहीं करेगा, और धारा 79 द्वारा उपविन्धत दशा के सिवाय कोई भी बन्धकदार, जो मध्यवर्ती बन्धक की सूचना होते हुए या न होते हुए बन्धककर्ता को पाश्चिक उधार दे, ऐसे पाश्चिक उधार के लिए अपनी प्रतिभूति के बारे में तद्द्वारा कोई पूर्विकता अर्जित नहीं करेगा।]
धारा 93 Transfer of property Act
[ Transfer of property Act Sec. 93 in English ] –
“Prohibition of tacking”–
No mortgagee paying off a prior mortgage, whether with or without notice of an intermediate mortgage, shall thereby acquire any priority in respect of his original security; and, except in the case provided for by section 79, no mortgagee- making a subsequent advance to the mortgagor, whether with or without notice of an intermediate mortgage, shall thereby acquire any priority in respect of his security for such subsequent advance.
