” विदेशी न्यायिक अभिलेखों की प्रमाणित प्रतियों के बारे में उपधारणा “
न्यायालय यह उपधारित कर सकेगा कि [*** ऐसे किसी देश के, जो भारत का या हर मजेस्टी के अधिक्षेत्रों का भाग नहीं है,] न्यायिक अभिलेख की प्रमाणित प्रति तात्पर्यित होने वाली कोई दस्तावेज असली और शुद्ध है, यदि वह दस्तावेज किसी ऐसी रीति से प्रमाणित हुई तात्पर्यित हो जिसका न्यायिक अभिलेखों की प्रतियों के प्रमाणन के लिए उस देश] में साधारणतः काम में लाई जाने वाली रीति होना [ऐसे देश में या के लिए] *** ‘[केन्द्रीय सरकार] के किसी प्रतिनधि द्वारा प्रमाणित है।
जो आफिसर ऐसे किसी *** राज्यक्षेत्र या स्थान के लिए, जो भारत का या] हर मजेस्टी के अधिक्षेत्रों का भाग नहीं है, साधारण खण्ड अधिनियम, 1897 (1897 का 10) की धारा 3 के खण्ड (43)] में यथा परिभाषित राजनैतिक अभिकर्ता है. वह इस धारा के प्रयोजनों के लिए केन्द्रीय सरकार] का”[उस देश में, और के लिए] प्रतिनिधि समझा जाएगा जिसमें वह राज्यक्षेत्र या स्थान समाविष्ट है।]
धारा 86 Indian Evidence Act
[ Indian Evidence Act Sec. 86 in English ] –
“ Presumption as to certified copies of foreign judicial records”–
The Court may presume that any document purporting to be a certified copy of any judicial record of 7[8* * * any country not forming part of India or] of Her Majesty’s Dominions is genuine and accurate, if the document purports to be certified in any manner which is certified by any representative of 9* * * the 3[Central Government] 10[in or for] 11[such country] to be the manner commonly in use in 12[that country] for the certification of of judicial records.
13[An officer who, with respect to 14*** any territory or place not forming part of 15[India or] Her Majesty’s Dominions, is a Political Agent there for, as defined in section 3, 16[clause (43)], of the General
Clauses Act, 1897 (10 of 1897), shall, for the purposes of this section, be deemed to be a representative of the 1[Central Government] 2[in and for the country] comprising that territory or place].
