प्रतिभूतियों का क्रमबंधन–
यदि दो या अधिक सम्पत्तियों का स्वामी उन्हें एक व्यक्ति के पास बन्धक रखता है और फिर उन सम्पत्तियों में से एक या अधिक को किसी अन्य व्यक्ति के पास बन्धक रखता है, तो तत्प्रतिकूल संविदा के अभाव में पाश्चिक बन्धकदार इस बात का हकदार है कि वह पूर्विक बन्धक ऋण को, उसे बंधक न की गई सम्पत्ति या सम्पत्तियों में से वहां तक तुष्ट करवाए जहां तक उससे या उनसे उसकी तुष्टि हो सकती है, किन्तु ऐसे नहीं कि पूर्विक बन्धकदार के या किसी ऐसे अन्य व्यक्ति के, जिसने उन सम्पत्तियों में से किसी भी सम्पत्ति में कोई हित प्रतिफलेन अर्जित किया है, अधिकारों पर प्रतिकूल प्रभाव पड़े।
धारा 81 Transfer of property Act
[ Transfer of property Act Sec. 81 in English ] –
“Marshalling securities”–
If the owner of two or more properties mortgages them to one person and then mortgages one or more of the properties to another person, the subsequent mortgagee is, in the absence of a contract to the contrary, entitled to have the prior mortgage- debt satisfied out of the property or properties not mortgaged to him, so far as the same will extend, but not so as to prejudice the rights of the prior mortgagee or of any other person who has for consideration acquired an interest in any of the properties.
