[ Indian Forest Act Section 79 in Hindi ] –
वन अधिकारियों और पुलिस अधिकारियों को सहायता देने के लिए आबद्ध व्यक्ति–
(1) ऐसा हर व्यक्ति, जो किसी आरक्षित या संरक्षित वन में किसी अधिकार का प्रयोग करता है, या ऐसे वन से किसी वन-उपज को लेने, या इमारती लकड़ी काटने और हटाने या उसमें ढोर चराने के लिए अनुज्ञात है, और हर व्यक्ति, जो ऐसे वन में किसी ऐसे व्यक्ति द्वारा नियोजित है, और ऐसे वन से समीपस्थ किसी ग्राम का हर व्यक्ति, जो सरकार द्वारा नियोजित है या जो समुदाय के प्रति की जाने वाली सेवाओं के लिए, सरकार से उपलब्धियां पाता है,
ऐसी जानकारी, जो किसी वन विषयक अपराध के किए जाने या किए जाने के आशय के विषय में उसके पास है, निकटतम वन अधिकारी या पुलिस अधिकारी को अनाश्यक विलम्ब के बिना देने के लिए आबद्ध होगा, और-
(क) ऐसे वन में किसी वन अग्नि को, जिसके बारे में उसे ज्ञान या जानकारी है, बुझाने के लिए,
(ख) ऐसे वन के सामीप्य में की किसी अग्नि को, जिसका उसे ज्ञान या जानकारी है, अपनी शक्ति के अनुसार किन्हीं वैध साधनों द्वारा ऐसे वन में फैल जाने से रोकने के लिए,
तुरन्त कार्यवाही करेगा चाहे उससे किसी वन अधिकारी या पुलिस अधिकारी द्वारा ऐसी अपेक्षा की गई हो या नहीं, और
(ग) ऐसे वन में वन विषयक अपराध को रोकने, और
(घ) जबकि यह विश्वास करने का कारण है कि ऐसे वन में ऐसा कोई अपराध किया गया है, तब अपराधी का पता चलाने और उसे गिरफ्तार करने में,
उसकी सहायता मांगने वाले किसी वन अधिकारी या पुलिस अधिकारी की सहायता करेगा ।
(2) जो कोई व्यक्ति ऐसा करने के लिए आबद्ध होते हुए विधिपूर्ण प्रतिहेतु के बिना (जिसे साबित करने का भार ऐसे व्यक्ति पर होगा-
(क) उपधारा (1) द्वारा अपेक्षित जानकारी निकटतम वन अधिकारी या पुलिस अधिकारी को अनावश्यक विलम्ब के बिना नहीं देगा,
(ख) किसी आरक्षित या संरक्षित वन में वन अग्नि को बुझाने के लिए उपधारा (1) द्वारा यथा अपेक्षित कार्यवाही नहीं करेगा,
(ग) ऐसे वन के सामीप्य में की किसी अग्नि को ऐसे वन में फैलने से नहीं रोकेगा जैसा कि उपधारा (1) द्वारा अपेक्षित है, या
(घ) ऐसे वन में किसी वन अपराध का किया जाना रोकने में या उस दशा में जिसमें कि यह विश्वास करने का कारण है कि ऐसे वन में ऐसा कोई अपराध हुआ है, अपराधी का पता चलाने और उसे गिरफ्तार करने में उसकी सहायता मांगी जाने पर किसी वन अधिकारी या पुलिस अधिकारी की मदद नहीं करेगा,
वह ऐसी अवधि के कारावास से, जो एक मास तक की हो सकेगी, या जुर्माने से, जो दो सौ रुपए तक का हो सकेगा, या दोनों से, दण्डनीय होगा ।
भारतीय वन अधिनियम धारा 79
[ Indian Forest Act Section 79 in English ] –
“Persons bound to assist Forest-officers and Police-officers ”–
(1) Every person who exercises any right in a reserved or protected forest, or who is permitted to take any forest-produce from, or to cut and remove timber or to pasture cattle in, such forest, and every person who is employed by any such person in such forest, and
every person in any village contiguous to such forest who is employed by the Government or who receives emoluments from the Government for services to be performed to the community,
shall be bound to furnish without unnecessary delay to the nearest Forest-officer or Police officer any information he may possess respecting the commission of, or intention to commit, any forest-offence, and shall forthwith take steps, whether so required by any Forest-officer or Police officer or not,-
(a) to extinguish any forest fire in such forest of which he has knowledge or information;
(b) to prevent by any lawful means in his power any fire in the vicinity of such forest of which he has knowledge or information from spreading to such forest, and shall assist any Forest-officer or Police-officer demanding his aid–
(c) in preventing the commission in such forest of any forest-offence; and
(d) when there is reason to believe that any such offence has been committed such forest in discovering and arresting the offender.
(2) Any person who, being bound so to do, without lawful excuse (the burden ofprovin which shall lie upon such person) fails–
(a) to furnish without unnecessary delay to the nearest Forest-officer or Polic( officer any
information required by sub-section (1);
(b) to take steps, as required by sub-section (1), to extinguish any forest fire in reserved or
protected forest;
(c) to prevent, as required by sub-section (1), any fire in the vicinity of such fore.4 from
spreading to such forest or
(d) to assist any Forest-officer or Police officer demanding his aid in preventing th commission in such forest of any forest-offence, or, when there is reason believe that any such offence has been committed in such forest, in discover’ and arresting the offender,
shall be punishable with imprisonment for a term which extend to one month, or with fine which may extend to two hundred rupees, or with both.
