बंधक-संपत्ति में अनुवृद्धि–
यदि बंधक की तारीख के पश्चात् बन्धक-सम्पत्ति में कोई अनुवृद्धि होती है, तो बन्धकदार तत्प्रतिकूल संविदा न हो तो, प्रतिभूति के प्रयोजनों के लिए ऐसी अनुवृद्धि का हकदार होगा।
दृष्टांत
(क) क नदी के किनारे वाला कोई खेत ख के पास बन्धक रखता है। वह खेत जलोढ़ से बढ़ जाता है। अपनी प्रतिभूति के प्रयोजनों के लिए ख इस वृद्धि का हकदार है।
(ख) क निर्माण भूमि का कोई टुकड़ा ख के पास बन्धक रखता है, और तत्पश्चात् उस टुकड़े पर गृह खड़ा करता है अपनी प्रतिभूति के प्रयोजनों के लिए ख गृह का तथा उस भूमि के टुकड़े का हकदार है।
धारा 70 Transfer of property Act
[ Transfer of property Act Sec. 70 in English ] –
“Accession to mortgaged property”–
If, after the date of a mortgage, any accession is made to the mortgaged property, the mortgagee, in the absence of a contract to the contrary, shall, for the purposes of the security, be entitled to such accession.
Illustrations
(a) A mortgages to B a certain field bordering on a river. The field is increased by alluvion. For the purposes of his security, B is entitled to the increase.
(b) A mortgages a certain plot of building land to B and afterwards erects a house on the plot. For the purposes of his
security, B is entitled to the house as well as the plot.
