पुरोबंध या विक्रय का अधिकार-
तत्प्रतिकूल संविदा न हो तो, बन्धकदार को यह अधिकार है कि बन्धक धन के अपने को अशोध्य] हो जाने के पश्चात् और बन्धक सम्पत्ति के मोचन के लिए डिक्री दी जाने से, या बन्धक धन चुकाए जाने से या यथा एतस्मिन्पश्चात् उपबन्धित तौर पर निक्षिप्त किए जाने से पहले किसी भी समय वह न्यायालय से यह [डिक्री] कि बन्धककर्ता उस सम्पत्ति का मोचन कराने के अपने अधिकार से आत्यन्तिक रूप से विवर्जित होगा या यह ‘डिक्री] कि वह सम्पत्ति बेच दी जाए अभिप्राप्त कर ले।
डिक्री अभिप्राप्त करने के लिए वाद कि बन्धकर्ता बन्धक सम्पत्ति का मोचन कराने के अपने अधिकार से आत्यन्तिक रूप से विवर्जित होगा, पुरोबन्ध वाद कहलाता है।
इस धारा की किसी भी बात से यह न समझा जाएगा कि वह-
(क) सशर्त विक्रय वाले बन्धकदार से भिन्न या ऐसे विलक्षण बन्धक वाले बन्धकदार से भिन्न, जिसके निबन्धन द्वारा वह पुरोबन्ध कराने का हकदार है, किसी बन्धकार को पुरोबन्ध वाद संस्थित करने या किसी भोग-बन्धकदार को अपनी वैसी हैसियत में या सशर्त विक्रय वाले किसी बन्धकदार को अपनी जैसी हैसियत में विक्रय के लिए बाद संस्थित करने को प्राधिकृत करती है ; अथवा
(ख) उस बन्धककर्ता को, जो बन्धकदार के अधिकार उसके न्यासधारी या विधिक प्रतिनिधि की हैसियत से धारित करता है और जो सम्पत्ति के विक्रय के लिए वाद ला सकता है, पुरोबन्ध वाद संस्थित करने को प्राधिकृत करती है : अथवा
(ग) रेल, नहर या अन्य ऐसे संकर्म के, जिसके कायम रखने में जनता हितबद्ध है, बन्धकदार को पुरोबन्ध या विक्रय के लिए वाद संस्थित करने को प्राधिकृत करती है : अथवा
(घ) बन्धक धन के भाग मात्र में हितबद्ध व्यक्ति को बंधक-सम्पत्ति के तत्सम भाग के सम्बन्ध में ही वाद संस्थित करने को प्राधिकृत करती है, जब तक कि बन्धकदारों ने बन्धककर्ता की सम्मति से बन्धक के अधीन के अपने हितों को विभक्त न कर लिया हो।
धारा 67 Transfer of property Act
[ Transfer of property Act Sec. 67 in English ] –
“Right to foreclosure or sale”–
In the absence of a contract to the contrary, the mortgagee has, at any time after the mortgage-money has become 3[due] to him, and before a decree has been made for the redemption of the mortgaged property, or the mortgage-money has been paid or deposited as hereinafter provided, a right to obtain from the Court 4[a decree] that the mortgagor shall be absolutely debarred of his right to redeem the property, or 4[a decree] that the property be sold. A suit to obtain 4[a decree] that a mortgagor shall be absolutely debarred of his right to redeem the mortgaged property is called a suit for foreclosure.
Nothing in this section shall be deemed—
(a) to authorise any mortgagee, other than a mortgagee by conditional sale or a mortgagee under an anomalous mortgage by the terms of which he is entitled to foreclose, to institute a suit for foreclosure, or an usufructuary mortgagee as such or a mortgagee by conditional sale as such to institute a suit for sale; or
(b) to authorise a mortgagor who holds the mortgagee’s rights as his trustee or legal representative, and who may sue for a sale of the property, to institute a suit for foreclosure; or
(c) to authorise the mortgagee of a railway, canal or other work in the maintenance of which the public are interested, to institute a suit for foreclosure or sale; or
(d) to authorise a person interested in part only of the mortgage-money to-institute a suit relating only to a corresponding part of the mortgaged property, unless the mortgagees have, with the consent of the mortgagor, severed their interests under the mortgage.
