[ Transfer of property Act Section 59 in Hindi ] –
बंधक कब हस्तान्तरण पत्र द्वारा किया जाना चाहिए-
जहां कि प्रतिभूत मूलधन सौ रुपए या उससे अधिक है, वहां वह बन्धक, [जो हक-विलेखों के निक्षेपों द्वारा बन्धक से भिन्न है] बन्धकर्ता द्वारा हस्ताक्षरित और कम से कम दो साक्षियों द्वारा अनुप्रमाणित रजिस्ट्रीकृत लिखत द्वारा ही किया जा सकेगा।
जहां कि प्रतिभूत मूलधन सौ रुपए से कम है वहां बन्धक या तो उपर्युक्त जैसे हस्ताक्षरित और अनुप्रमाणित रजिस्ट्रीकृत लिखत द्वारा या (सिवाय सादा बन्धक की दशा में के) सम्पत्ति के परिदान द्वारा किया जा सकेगा।
धारा 59 Transfer of property Act
[ Transfer of property Act Sec. 59 in English ] –
“Mortgage when to be by assurance”–
Where the principal money secured is one hundred rupees or upwards, a mortgage 5[other than a mortgage by deposit of title-deeds], can be effected only by a registered instrument signed by the mortgagor and attested by at least two witnesses.
Where the principal money secured is less than one hundred rupees, a mortgage may be effected either by 6[a registered instrument] signed and attested as aforesaid, or (except in the case of a simple mortgage) by delivery of the property.
