अमुक दिन पर पालन के लिए आवेदन उचित समय और स्थान पर किया जाएगा–
जब कि किसी वचन का पालन अमुक दिन किया जाना हो और वचनदाता ने यह भार अपने ऊपर न ले लिया हो कि वह वचनगृहीता के आवेदन के बिना उसका पालन करेगा तब वचनगृहीता का यह कर्तव्य है कि पालन के लिए आवेदन उचित स्थान पर और कारबार के प्रायिक घंटों के भीतर करे।
स्पष्टीकरण-“उचित समय और स्थान क्या है, यह प्रश्न हर एक विशिष्ट मामले में तथ्य का प्रश्न है।
धारा 48 Indian Contract act
[ Indian Contract act Sec. 48 in English ] –
“Application for performance on certain day to be at proper time and place”–
When a promise is to be performed on a certain day, and the promisor has not undertaken to perform it without application by the promisee, it is the duty of the, promisee to apply for performance at a proper place and within the usual hours of business.
Explanation.—The question “what is a proper time and place” is, in each particular case, a question of fact.
