कुछ मामलों में विचारण लंबित रहने तक सम्पत्ति की अभिरक्षा और व्ययन के लिए आदेश–
जब कोई सम्पत्ति, किसी दंड न्यायालय के समक्ष किसी जांच या विचारण के दौरान पेश की जाती है तब वह न्यायालय उस जांच या विचारण के समाप्त होने तक ऐसी सम्पत्ति की उचित अभिरक्षा के लिए ऐसा आदेश, जैसा वह ठीक समझे, कर सकता है और यदि वह सम्पत्ति शीघ्रतया या प्रकृत्या क्षयशील है या यदि ऐसा करना अन्यथा समीचीन है तो वह न्यायालय, ऐसा साक्ष्य अभिलिखित करने के पश्चात् जैसा वह आवश्यक समझे, उसके विक्रय या उसका अन्यथा व्ययन किए जाने के लिए आदेश कर सकता है।
स्पष्टीकरण-इस धारा के प्रयोजन के लिए “सम्पत्ति के अन्तर्गत निम्नलिखित है,
(क) किसी भी किस्म की सम्पत्ति या दस्तावेज जो न्यायालय के समक्ष पेश की जाती है या जो उसकी अभिरक्षा में है,
(ख) कोई भी सम्पत्ति जिसके बारे में कोई अपराध किया गया प्रतीत होता है या जो किसी अपराध के करने में प्रयुक्त की गई प्रतीत होती है।
धारा 451 CrPC
[ CrPC Sec. 451 in English ] –
“Order for custody and disposal of property pending trial in certain cases ”–
When any property is produced before any Criminal Court during any inquiry or trial, the Court may make such order as it thinks fit for the proper custody of such property pending the conclusion of the inquiry or trial, and, if the property is subject to speedy and natural decay, or if it is otherwise expedient so to do, the Court may, after recording such evidence as it thinks necessary, order it to be sold or otherwise disposed of.
Explanation.- For the purposes of this section,” property” includes-
