विभाजन पर बाध्यता के फायदे का प्रभाजन-
जबकि अंतरण के परिणामस्वरूप सम्पत्ति विभाजित और कई अंशों में धारित है और तदुपरि पूरी सम्पत्ति से सम्बन्धित किसी बाध्यता का फायदा उस सम्पत्ति के एक स्वामी से कई स्वामियों को संक्रान्त हो जाता है, तब तत्संबंधी कर्तव्य का पालन, स्वामियों के बीच कोई तत्प्रतिकूल संविदा न हो तो, ऐसे स्वामियों में से हर एक के पक्ष में उस अनुपात में किया जाएगा जो सम्पत्ति में उसके अंश मूल्य का है, परन्तु यह तब जब कि कर्तव्य का विभाजन किया जा सकता हो और उस विभाजन से बाध्यता का बोझ सारवान् रूप में बढ़ नहीं जाता, किन्तु यदि कर्तव्य का विभाजन नहीं किया जा सकता अथवा विभाजन बाध्यता के बोझ को सारवान् रूप में बढ़ाता है, तो कर्तव्य पालन कई स्वामियों में ऐसे एक के फायदे के लिए किया जाएगा जिसे वे संयुक्त तौर पर उस प्रयोजन के लिए अभिहित कर दें:
परन्तु कोई भी व्यक्ति, जिस पर बाध्यता का बोझ हो, उसका इस धारा द्वारा उपबन्धित प्रकार से निर्वहन करने में असफलता के लिए उत्तरदायी नहीं होगा। यदि और जब तक उसे विभाजन की युक्तियुक्त सूचना न मिल गई हो।
इस धारा की कोई भी बात ऐसे पट्टों को, जो कृषि प्रयोजनों के लिए हों, लागू नहीं होगी यदि और जब तक राज्य सरकार उसे उन पट्टों को लागू करने का निदेश शासकीय राजपत्र में अधिसूचना द्वारा न दे दे।
दृष्टांत
(क) क किसी गांव में स्थित ऐसा गृह, जो ङ को 30 रुपए और एक मोटी भेड़ के परिदान के वार्षिक भाटक पर पट्टे पर दिया हुआ है, ख, ग और घ को बेचता है । क्रय मूल्य का ख ने आधा रुपया और ग और घ में से हर एक ने एक चौथाई दिया है। ङ को उसकी सूचना है अतः वह पन्द्रह रुपए ख को, साढ़े सात रुपए ग को, साढ़े सात रुपए घ को देगा और भेड़ का परिदान ख, ग और घ के संयुक्त निदेश के अनुसार करेगा।
(ख) उसी दृष्टांत में गांव का हर एक गृह बाड़ रोकने के लिए तटबंध में प्रति वर्ष 10 दिन के श्रम का प्रदाय करने के लिए आबद्ध है और ङ ने अपने पट्टे के निबंधन के तौर पर क के लिए यह काम करने का करार किया था। ख, ग और घ में से हर एक अपने गृह की ओर से अलग-अलग 10 दिन तक काम करने की अपेक्षा ङ से करते हैं । ङ ऐसे निदेशों के अनुसार जैसा सम्मिलित होकर ख, ग और घ दें, कुल 10 दिन से अधिक काम करने के लिए आबद्ध नहीं हैं।
धारा 37 Transfer of property Act
[ Transfer of property Act Sec. 37 in English ] –
“Apportionment of benefit of obligation on severance”–
When, in consequence of a transfer, property is divided and held in several shares, and thereupon the benefit of any obligation relating to the property as a whole passes from one to several owners of the property, the corresponding duty shall, in the absence of a contract to the contrary amongst the owners, be performed in favour of each of such owners in proportion to the value of his share in the property, provided that the duty can be severed and that the severance does not substantially increase the burden of the obligation; but if the duty cannot be severed, or if the severance would substantially increase the burden of the obligation the duty shall be performed for the benefit of such one of the several owners as they shall jointly designate for that purpose:
Provided that no person on whom the burden of the obligation lies shall be answerable for failure to discharge it in manner provided by this section, unless and until he has had reasonable notice of the severance.
Nothing in this section applies to leases for agricultural purposes unless and until the State Government by notification in the Official Gazette so directs.
Illustrations
(a) A sells to B, C and D a house situated in a village and leased to E at an annual rent of Rs. 30 and delivery of one fat sheep, B having provided half the purchase-money and C and D one quarter each. E, having notice of this, must pay Rs. 15 to B, Rs. 7.50 to C, and Rs. 7.50 to D, and must deliver the sheep according to the Joint direction of B, C and D.
(b) In the same case, each house in the village being bound to provide ten days’ labour each year on a duke to prevent inundation E had agreed as a term of his lease to perform this work for A. B, C and D severally require E to perform the ten days’ work due on account of the house of each. E is not bound to do more than ten days’ work in all, according to such directions as B, C and D may join in giving.
