[ CrPC Sec. 332 in Hindi ] –
मजिस्ट्रेट या न्यायालय के समक्ष अभियुक्त के हाजिर होने पर प्रक्रिया–
(1) जब अभियुक्त, यथास्थिति, मजिस्ट्रेट या न्यायालय के समक्ष हाजिर होता है या पुनः लाया जाता है, तब यदि मजिस्ट्रेट या न्यायालय का यह विचार है कि वह अपनी प्रतिरक्षा करने में समर्थ है तो, जांच या विचारण आगे चलेगा।
(2) यदि मजिस्ट्रेट या न्यायालय का यह विचार है कि अभियुक्त अभी अपनी प्रतिरक्षा करने में असमर्थ है तो मजिस्ट्रेट या न्यायालय, यथास्थिति, धारा 328 या धारा 329 के उपबंधों के अनुसार कार्यवाही करेगा और यदि अभियुक्त विकृतचित्त और परिणामस्वरूप अपनी प्रतिरक्षा करने में असमर्थ पाया जाता है तो ऐसे अभियुक्त के बारे में वह धारा 330 के उपबंधों के अनुसार कार्यवाही करेगा।
धारा 332 CrPC
[ CrPC Sec. 332 in English ] –
“Procedure on accused appearing before Magistrate or Court”–
- If, when the accused appears or is again brought before the Magistrate or Court, as the case may be, the Magistrate or Court considers him capable of making his defence, the inquiry or trial shall proceed.
- If the Magistrate or Court considers the accused to be still incapable of making his defence, the Magistrate or Court shall act according to the provisions or section 328 or section 329, as the case may be, and if the accused is found to be of unsound mind and consequently incapable of making his defence, shall deal with such accused in accordance with the provisions of section 330.
