[ Specific relief act Sec. 29 in Hindi ] –
विनिर्दिष्ट पालन के बाद में विखंडन की अनकल्पिक प्रार्थना-
किसी लिखित संविदा के विनिर्दिष्ट पालन का वाद संस्थित करने वाला वादी अनुकल्पतः यह प्रार्थना कर सकेगा कि यदि संविदा विनिर्दिष्टतः प्रवर्तित नहीं की जा सकती, तो वह विखंडित कर दी जाए और रद्द किए जाने के लिए न्यायालय को परिदत कर दी जाए और न्यायालय यदि संविदा को विनिर्दिष्टतः प्रवर्तित कराने से इन्कार कर दे तो वह तदनुसार उसके विखंडित और न्यायालय को परिदत्त किए जाने को निर्दिष्ट कर सकेगा।
धारा 29 Specific relief act
[ Specific relief act Sec. 29 in English ] –
“ Alternative prayer for rescission in suit for specific performance ”–
A plaintiff instituting a suit for the specific performance of a contract in writing may pray in the alternative that, if the contract cannot be specifically enforced, it may be rescinded and delivered up to be cancelled; and the court, if it refuses to enforce the contract specifically, may direct it to be rescinded and delivered up accordingly.
