” अपत्यों की अभिरक्षा”
इस अधिनियम के अधीन होने वाली किसी भी कार्यवाही में न्यायालय अप्राप्तवय अपत्यों की अभिरक्षा, भरण-पोषण और शिक्षा के बारे में, यथासंभव उनकी इच्छा के अनुकूल, समय-समय पर ऐसे आदेश पारित कर सकेगा और डिक्री में ऐसे उपबंध कर सकेगा जिन्हें वह न्यायसंगत और उचित समझे और डिक्री के पश्चात् इस प्रयोजन से अर्जी द्वारा किए गए आवेदन पर ऐसे अपत्य की अभिरक्षा, भरण-पोषण और शिक्षा के बारे में समय-समय पर ऐसे आदेश और उपबंध कर सकेगा जो ऐसी डिक्री अभिप्राप्त करने की कार्यवाही के लंबित रहते ऐसी डिक्री या अन्तरिम आदेश द्वारा किए जा सकते थे और न्यायालय पूर्वतन किए गए किसी आदेश या उपबंध को समय-समय पर प्रतिसहत या निलंबित कर सकेगा, अथवा उसमें फेरफार कर सकेगा:
परंतु भरण-पोषण और अवयस्क बालकों की शिक्षा सम्बन्धित आवेदन, लम्बित कार्यवाही में डिक्री प्राप्त करने के, को, यथासंभव प्रत्यर्थी पर नोटिस की तामील से साठ दिनों में निपटाएंगे।
धारा 26 Hindu Marriage Act
[ Hindu Marriage Act Sec. 26 in English ] –
“Custody of children”–
In any proceeding under this Act, the Court may, from time to time, pass such interim orders and make such provisions in the decree as it may deem just and proper with respect to the custody, maintenance and education of minor children, consistently with their wishes, wherever possible, and may, after the decree, upon application by petition for the purpose, make from time to time, all such orders and provisions with respect to the custody, maintenance and education of such children as might have been made by such decree or interim orders in case the proceedings for obtaining such decree were still pending, and the Court may also from time to time revoke, suspend or vary any such orders and provisions previously made.
