उन्मोचन-
यदि मामले के अभिलेख और उसके साथ दी गई दस्तावेजों पर विचार कर लेने पर, और इस निमित्त अभियुक्त और अभियोजन के निवेदन की सुनवाई कर लेने के पश्चात् न्यायाधीश यह समझता है कि अभियुक्त के विरुद्ध कार्यवाही करने के लिए पर्याप्त आधार नहीं है तो वह अभियुक्त को उन्मोचित कर देगा और ऐसा करने के अपने कारणों को लेखबद्ध करेगा।
धारा 227 CrPC
[ CrPC Sec. 227 in English ] –
“ Discharge ”–
If, upon consideration of the record of the case and the documents submitted therewith, and after hearing the submissions of the accused and the prosecution in this behalf, the Judge considers that there is not sufficient ground for proceeding against the accused, he shall discharge the accused and record his reasons for so doing.
