पॉक्सो एक्ट की धारा 21 | Section 21 of Pocso Act
[ Pocso Act Sec. 21 in Hindi ] –
मामले को रिपोर्ट करने या अभिलिखित करने में विफल रहने के लिए दंड .-
(1) कोई व्यक्ति जो धारा 19 की उपधारा (1) या धारा 20 के अधीन किसी अपराध के किए जाने की रिपोर्ट करने में विफल रहेगा या जो धारा 19 की उपधारा (2) के अधीन ऐसे अपराध को अभिलिखित करने में विफल रहेगा, वह किसी भी भांति के कारावास से, जो छह मास तक का हो सकेगा या जुर्माने से या दोनों से, दंडित किया जाएगा।
(2) किसी कंपनी या किसी संस्था (चाहे जिस नाम से ज्ञात हो) का भारसाधक कोई व्यक्ति जो अपने नियंत्रणाधीन किसी अधीनस्थ के संबंध में धारा 19 की उपधारा (1) के अधीन किसी अपराध के किए जाने की रिपोर्ट करने में विफल रहेगा, वह ऐसी अवधि के कारावास से जो एक वर्ष तक का हो सकेगा और जुर्माने से दंडित किया जाएगा।
(3) उपधारा (1) के उपबंध इस अधिनियम के अधीन किसी बालक को लागू नहीं होंगे।
धारा 21 Pocso Act
[ Pocso Act Sec. 21 in English ] –
“Punisment for failure to report or case”–
(1) Any person, who fails to report the commission of an offence under sub section (1) of section 19 or section 20 or who fails to record such offence under sub–section (2) of section 19 shall be punished with imprisonment of either description which may extend to six months or with fine or with both.
(2) Any person, being in–charge of any company or an institution (by whatever name called) who fails to report the commission of an offence under sub–section (1) of section 19 in respect of a subordinate under his control, shall be punished with imprisonment for a term which may extend to one year and with fine.
(3) The provisions of sub–section (1) shall not apply to a child under this Act.
