अनुतोष का वैयक्तिक वर्जन-
संविदा का विनिर्दिष्ट पालन किसी ऐसे व्यक्ति के पक्ष में नहीं कराया जा सकता-
(क) जो उसके भंग के लिए प्रतिकर वसूल करने का हकदार न हो, अथवा
(ख) जो संविदा के किसी मर्मभूत निबन्धन का, जिसका उसकी ओर से पालन किया जाना शेष हो, पालन करने में असमर्थ हो गया हो, या उसका अतिक्रमण करे. या संविदा के प्रति कपट करे अथवा जानबूझकर ऐसा कार्य करे जो संविदा द्वारा स्थापित किए जाने के लिए आशयित संबंध का विसंवादी या ध्वसंक हो; अथवा
(ग) जो यह प्रकथन करने और साबित करने में असफल रहे कि उसके संविदा के उन निबन्धनों से भिन्न जिनका पालन प्रतिवादी द्वारा निवारित अथवा अधित्यक्त किया गया है, ऐसे मर्मभूत निबन्धनों का, जो उसके द्वारा पालन किए जाने हैं, उसने पालन कर दिया है अथवा पालन करने के लिए वह सदा तैयार और रजामन्द रहा है।
स्पष्टीकरण-खण्ड (ग) के प्रयोजनों के लिए
(i) जहाँ कि संविदा में धन का संदाय अन्तर्वलित हो, वादी के लिए आवश्यक नहीं है कि वह प्रतिवादी को किसी धन का वास्तव में निविदान करे या न्यायालय में निक्षेप करे सिवाय जबकि न्यायालय ने ऐसा करने का निदेश दिया हो;
(ii) वादी को यह प्रकथन करना होगा कि वह संविदा का उसके शुद्ध अर्थान्वयन के अनुसार पालन कर चुका, अथवा पालन करने को तैयार और रजामन्द है।
धारा 16 Specific relief act
[ Specific relief act Sec. 16 in English ] –
“ Personal bars to relief ”–
Specific performance of a contract cannot be enforced in favour of a person—
(a) who would not be entitled to recover compensation for its breach ; or
(b) who has become incapable of performing, or violates any essential term of, the contract that on his part remains to be performed, or acts in fraud of the contract, or wilfully acts at variance with, or in subversion of, the relation intended to be established by the contract; or
(c) who fails to prove] that he has performed or has always been ready and willing to perform the essential terms of the contract which are to be performed by him, other than terms of the performance of which has been prevented or waived by the defendant.
Explanation.—For the purposes of clause (c),—
(i) where a contract involves the payment of money, it is not essential for the plaintiff to actually tender to the defendant or to deposit in court any money except when so directed by the court;
(ii) the plaintiff must aver performance of, or readiness and willingness to perform, the contract according to its true construction.
