संदाय या पालन होने पर प्रतिभू के अधिकार–
जहां कि कोई प्रत्याभूत ऋण शोध्य हो गया हो, या प्रत्याभूत कर्तव्य के पालन में मूलऋणी से व्यतिक्रम हो गया हो वहां वे सब अधिकार, जो लेनदार को मूलऋणी के विरुद्ध प्राप्त हों, प्रतिभू द्वारा उस सब के. जिसके लिए वह दायी हो, संदाय या पालन पर प्रतिभू में विनिहित हो जाते हैं।
धारा 140 Indian Contract act
[ Indian Contract act Sec. 140 in English ] –
“Rights of surety on payment or performance”–
Where a guaranteed debt has become due, or default of the principal debtor to perform a guaranteed duty has taken place, the surety upon payment or performance of all that he is liable for, is invested with all the rights which the creditor had against the principal debtor.
