भारतीय संविदा अधिनियम की धारा 12 | Section 12 of Indian Contract act

संविदा करने के प्रयोजनों के लिए स्वस्थचित्त क्या है-
कोई व्यक्ति संविदा करने के प्रयोजन के लिए स्वस्थचित्त कहा जाता है, यदि वह उस समय, जब वह संविदा करता है उस संविदा को समझने में और अपने हितों पर उसके प्रभाव के बारे में युक्तिसंगत निर्णय लेने में समर्थ है।
जो व्यक्ति प्राय: विकृतचित्त रहता है किन्तु कभी-कभी स्वस्थचित्त हो जाता है, वह जब स्वस्थचित्त हो तब संविदा कर सकेगा।
जो व्यक्ति प्राय: स्वस्थचित रहता है किंतु कभी-कभी विकृतचिन्त हो जाता है, वह जब विकृतचित्त हो तब संविदा नहीं कर सकेगा।
दृष्टांत
(क) पागलखाने का एक रोगी, जो अन्तरालों में स्वस्थचित्त हो जाता है, उन अन्तरालों के दौरान में संविदा कर सकेगा।
(ख) वह स्वस्थचित्त मनुष्य, जो ज्वर से चित्तविपर्यस्त है या जो इतना मत्त है कि वह संविदा के निबंधनों को नहीं समझ सकता या अपने हितों पर उसके प्रभाव के बारे में युक्तिसंगत निर्णय नहीं ले सकता तब तक संविदा नहीं कर सकता जब तक ऐसी चित्तविपर्यस्तता या मत्तता बनी रहे।
धारा 12 Indian Contract act
[ Indian Contract act Sec. 12 in English ] –
“ What is a sound mind for the purposes of contracting”–
A person is said to be of sound mind for the purpose of making a contract, if, at the time when he makes it, he is capable of understanding it and of forming a rational judgment as to its effect upon his interests.
A person who is usually of unsound mind, but occasionally of sound mind, may make a contract when he is of sound mind.
A person who is usually of sound mind, but occasionally of unsound mind, may not make a contract when he is of unsound mind.
Illustrations
(a) A patient in a lunatic asylum, who is at intervals of sound mind, may contract during those intervals.
(b) A sane man, who is delirious from fever or who is so drunk that he cannot understand the terms of a contract, or form a rational judgment as to its effect on his interests, cannot contract whilst such delirium or drunkenness lasts.
