“बलात्संग के लिए कतिपय अभियोजन में सम्मति के न होने की उपधारणा “
भारतीय दंड संहिता (1860 का 45) की धारा 376 की उपधारा (2) के खंड (क), खंड (ख), खंड (ग), खंड (घ), खंड (ङ), खंड (च), खंड (छ), खंड (ज), खंड (झ), खंड (ब), खंड (ट), खंड (ठ), खंड (ड) या खंड (ढ) के अधीन बलात्संग के लिए किसी अभियोजन में, जहां अभियुक्त द्वारा मैथुन किया जाना साबित हो जाता है और प्रश्न यह है कि क्या वह उस स्त्री की, जिसके बारे में यह अभिकथन किया गया है कि उससे बलात्संग किया गया है, सम्मति के बिना किया गया था और ऐसी स्त्री न्यायालय के समक्ष अपने साक्ष्य में यह कथन करती है कि उसने सम्मति नहीं दी थी, वहां न्यायालय यह उपधारणा करेगा कि उसने सम्मति नहीं दी थी।
स्पष्टीकरण-इस धारा में “मैथुन” से भारतीय दंड संहिता (1860 का 45) की धारा 375 के खण्ड (क) से खाण्ड (घ) में वर्णित कोई कार्य अभिप्रेत होगा।
धारा 114A Indian Evidence Act
[ Indian Evidence Act Sec. 114A in English ] –
“Presumption as to absence of consent in certain prosecution for rape”–
In a prosecution for rape under clause (a), clause (b), clause (c), clause (d), clause (e), clause (f), clause (g), clause (h), clause (i), clause (j), clause (k), clause (l), clause (m) or clause (n) of sub-section (2) of section 376 of the Indian Penal Code (45 of 1860), where sexual intercourse by the accused is proved and the question is whether it was without the consent of the woman alleged to have been raped and such woman states in her evidence before the court that she did not consent, the court shall presume that she did not consent.
Explanation.–– In this section, “sexual intercourse” shall mean any of the acts mentioned in clauses (a) to (d) of section 375 of the Indian Penal Code (45 of 1860).
