[ CrPC Sec. 105d in Hindi ] –
विधिविरुद्धतया अर्जित संपत्ति की पहचान करना—
(1) न्यायालय, धारा 105ग की उपधारा (1) के अधीन या उसकी उपधारा (8) के अधीन अनुरोध-पत्र प्राप्त होने पर पुलिस उप-निरीक्षक से अनिम्न पंक्ति के किसी पुलिस अधिकारी को ऐसी संपत्ति का पता लगाने और पहचान करने के लिए सभी आवश्यक कार्रवाई करने के लिए निदेश देगा।
(2) उपधारा (1) में निर्दिष्ट कार्रवाई के अंतर्गत, किसी व्यक्ति, स्थान, संपत्ति, आस्ति, दस्तावेज, किसी बैंक या सार्वजनिक वित्तीय संस्था की लेखाबही या किसी अन्य सुसंगत विषय की बाबत जांच, अन्वेषण या सर्वेक्षण भी हो सकेगा।
(3) उपधारा (2) में निर्दिष्ट कोई जांच, अन्वेषण या सर्वेक्षण, उक्त न्यायालय द्वारा इस निमित्त दिए गए निदेशों के अनुसार उपधारा (1) में उल्लिखित अधिकारी द्वारा किया जाएगा।
धारा 105d CrPC
[ CrPC Sec. 105d in English ] –
“ Identifying unlawfully acquired property ”–
- The Court shall, under Sub-Section (1), or on receipt of a letter of request under Sub-Section (3) of section 105C, direct any police officer not below the rank of Sub-Inspector of Police to lake all steps necessary for tracing and identifying such property.
- The steps referred to in Sub-Section (1) may include any inquiry, investigation or survey in respect of any person, place, property, assets, documents, books of account in any bank or public financial institutions or any other relevant matters.
- Any inquiry, investigation or survey referred to in Sub-Section (2) shall be carried out by an officer mentioned in Sub-Section (1) in accordance with such directions issued by the said Court in this behalf.
