भारतीय दंड संहिता की धारा 415 क्या है | 415 Ipc in Hindi

[ Ipc Sec. 415 ] हिंदी में –

 छल–

जो कोई किसी व्यक्ति से प्रवंचना कर उस व्यक्ति को, जिसे इस प्रकार प्रवंचित किया गया है. कपटपूर्व या बेईमानी से उत्प्रेरित करता है कि वह कोई संपत्ति किसी व्यक्ति को परिदत्त कर दे या यह सम्मति दे दे कि कोई व्यक्ति किसी संपत्ति को रख रखे या साशय उस व्यक्ति को, जिसे इस प्रकार प्रवंचित किया गया है, उत्प्रेरित करता है कि वह ऐसा कोई कार्य करे, या करने का लोप करे जिसे वह यदि उसे इस प्रकार प्रवंचित न किया गया होता तो, न करता, या करने का लोप न करता, और जिस कार्य या लोप से उस व्यक्ति को शारीरिक, मानसिक, ख्याति संबंधी या साम्पत्तिक नुकसान या अपहानि कारित होती है, या कारित होनी सम्भाव्य है, वह “छल” करता है, यह कहा जाता है ।

स्पष्टीकरण–तथ्यों का बेईमानी से छिपाना इस धारा के अर्थ के अंतर्गत प्रवंचना है ।

दृष्टांत

(क) क सिविल सेवा में होने का मिथ्या अपदेश करके साशय य से प्रवंचना करता है, और इस प्रकार बेईमानी से य को उत्प्रेरित करता है कि वह उसे उधार पर माल ले लेने दे, जिसका मूल्य चुकाने का उसका इरादा नहीं है | क छल करता है ।

(ख) क एक वस्तु पर कूटकृत चिह्न बनाकर य से साशय प्रवंचना करके उसे यह विश्वास कराता है कि वळ वस्तु किसी प्रसिद्ध विनिर्माता द्वारा बनाई गई है, और इस प्रकार उस वस्तु का क्रय करने आर उसका मूल्य चुकाने के लिए य को बेईमानी से उत्प्रेरित करता है | क छल करता है।

(ग) क, य को किसी वस्तु का, नकली सैम्पल दिखालाकर य से साशय प्रवंचना करके उसे यह विश्वास कराता है कि वह वस्तु सैम्पल के अनुरूप है, और तद्वारा उस वस्तु को खरीदने और उसका मूल्य चुकाने के लिए य को बेईमानी से उत्प्रेरित करता है | क छल करता है।

(घ) क किसी वस्तु का मूल्य देने में ऐसी कोठी पर हुंडी करके, जहां क का कोई धन जमा नहीं है, और जिसके द्वारा क को हुंडी का अनादर किए जाने की प्रत्याशा है, साशय य से प्रवंचना करता है, और तद्वारा बेईमानी से य को उलमेरित करता है कि वह वस्तु परिदत्त कर दे जिसका मूल्य चुकाने का उसका आशय नहीं है | क छल करता है।

(ङ) क ऐसे नगों को, जिनको वह जानता है वे हीरे नहीं हैं, हीरों के रूप में गिरवी रखकर य से साशय प्रवंचना करता है, और तद्वारा धन उधार देने के लिए य को बेईमानी से उत्प्रेरित करता हैं | क छल करता है।

(च) क साशय प्रवंचना करके य को यह विश्वास कराता है कि क को जो धन य उधार देगा उसे वह चुका देगा, और तदृद्वारा बेईमानी से य को उत्प्रेरित करता है कि वह उसे धन उधार दे दे जबकि क का आशय उस धन को चुकाने का नहीं है | क छल करता है |

(छ) क, य से साशय प्रवंचना करके यह विश्वास दिलाता है कि क का इरादा य को नील को पौधों का एक निश्चित परिमाण परिदत्त करने का है, जिसको परिदत्त करने का उसका आशय नहीं है, और तद्वारा ऐसे परिदान के विश्वास पर अग्निम धन देने के लिए य को बेईमानी से उत्प्रेरित करता है | क छल करता है | यदि क बन अभिप्राप्त करते समय नील परिदत्त करने का आशय रखता हो, और उसके पश्चात् अपनी संविदा भंग कर दे और वह उसे परिदत्त न करे तो वह छल नहीं करता है, किंतु संविदा भंग करने के लिए केवल सिविल कार्यवाही के दायित्व के अधीन है।

(ज) क साशय प्रवंचना करके य को यह विश्वास दिलाता है कि क ने य के साथ की गई संविदा के अपने भाग का पालन कर दिया है, नहीं किया है, और तद्वारा य को बेईमानी से उत्प्रेरित करता है कि वह धन दे | क छल करता ।

(झ) क, ख को एक संपदा बेचता है और उस्तांतरित करता है | क यह जानते हुए कि ऐसे विक्रय के परिणामस्वरूप उस संपत्ति पर उसका कोई अधिकार नहीं है. ख को किए गए पूर्व विक्रय और हस्तांतरण के तथ्य को प्रकट न करते हुए उसे य के हाथ बेच देता है या बंधक रख देता है, और य से विक्रय या बंधक धन प्राप्त कर लेता है | क छल करता है।

[ Ipc Sec. 415 ] अंग्रेजी में –

“ Cheating ”–

Whoever, by deceiving any person, fraudulently or dishonestly induces the person so deceived to deliver any proper­ty to any person, or to consent that any person shall retain any property, or intentionally induces the person so deceived to do or omit to do anything which he would not do or omit if he were not so deceived, and which act or omission causes or is likely to cause damage or harm to that person in body, mind, reputation or property, is said to “cheat”.

Explanation.—A dishonest concealment of facts is a deception within the meaning of this section.

Illustrations
(a) A, by falsely pretending to be in the Civil Service, inten­tionally deceives Z, and thus dishonestly induces Z to let him have on credit goods for which he does not mean to pay. A cheats.
(b) A, by putting a counterfeit mark on an article, intentionally deceives Z into a belief that this article was made by a certain celebrated manufacturer, and thus dishonestly induces Z to buy and pay for the article. A cheats.
(c) A, by exhibiting to Z a false sample of an article, inten­tionally deceives Z into believing that the article corresponds with the sample, and thereby, dishonestly induces Z to buy and pay for the article. A cheats.
(d) A, by tendering in payment for an article a bill on a house with which A keeps no money, and by which A expects that the bill will be dishonored, intentionally deceives Z, and thereby dishonestly induces Z to deliver the article, intending not to pay for it. A cheats.
(e) A, by pledging as diamonds article which he knows are not diamonds, intentionally deceives Z, and thereby dishonestly induces Z to lend money. A cheats.
(f) A intentionally deceives Z into a belief that A means to repay any money that Z may lend to him and thereby dishonestly induces Z to lend him money. A not intending to repay it. A cheats.
(g) A intentionally deceives Z into a belief that A means to deliver to Z a certain quantity of indigo plant which he does not intend to deliver, and thereby dishonestly induces Z to advance money upon the faith of such delivery. A cheats; but if A, at the time of obtaining the money, intends to deliver the indigo plant, and afterwards breaks his contract and does not deliver it, he does not cheat, but is liable only to a civil action for breach of contract.
(h) A intentionally deceives Z into a belief that A has performed A’s part of a contract made with Z, which he has not performed, and thereby dishonestly induces Z to pay money. A cheats.
(i) A sells and conveys an estate to B. A, knowing that in conse­quence of such sale he has no right to the property, sells or mortgages the same to Z, without disclosing the fact of the previous sale and conveyance to B, and receives the purchase or mortgage money from Z. A cheats.
